Aguiar-Branco calls for an investigation into statements made by congresswoman Isabel Moreira following a complaint by Hugo Soares

The president of the Assembly of the Republic asked the Transparency Commission to open an investigation into the statements made by PS deputy Isabel Moreira in the debate on diplomas on gender change, following a complaint from the PSD parliamentary leader.

In the order, which Lusa had access to today, José Pedro Aguiar-Branco admitted that the statements attributed to the socialist deputy in Friday’s debate “have enough objective gravity to justify investigation”.

Hugo Soares called for an investigation to be opened for an alleged serious violation of the duties of deputies after Isabel Moreira said, in plenary, that the PSD, Chega and CDS-PP bills – all relating to the legal regime for changing sex and first name in the civil registry – “ratified the murder of Gisberta”, a transsexual woman who in 2006 was attacked and killed by a group of teenagers in the city of Porto.

“The applicant maintains that such a formulation is equivalent, even if indirectly, to attributing to the deputies who signed and supported these initiatives, including the PSD deputies, a moral or political responsibility for legitimizing a homicide, which would constitute a serious offense to their honor and dignity, as well as harm to the dignity and prestige of the Legislative Assembly”says the order.

In addition to the statements in plenary, Hugo Soares added to the complaint a publication by the same deputy on the social network X, in which he wrote: “The PSD has capitulated once and for all. The end of the autonomy of all trans people has just been approved. Yes, adults, too. They approved the Chega and CDS diploma. It’s as if they were saying that it made sense to throw Gisberta into a well. Kill her. Not a vote outside of discipline”.

When considering the complaint, the President of the Assembly of the Republic considered that the language used could “go beyond the level of vigorous political criticism and enter the realm of moral disqualification of the proponents and supporters of the initiatives in question”.

“By associating the respective legislative impulse with the ‘ratification’ of a murder, the expression used is likely to project onto certain deputies a censorship of exceptional gravity, thus raising, in a well-founded way, the question of its compatibility with the duties of respect, civility and institutional loyalty that impose on all members of the Assembly of the Republic”he said.

Aguiar-Branco considered that, “without prejudice to the contradictory and additional verification that proves to be due”these statements by the PT deputy, as well as the publication on the social network, are subject to “of compromising the honor and dignity of certain deputies, of calling for the duty of respect provided for in subparagraph e) of no..

Therefore, the president of parliament ordered the request to open an investigation to the Parliamentary Commission for Transparency and Statute of Deputies and, in addition to notifying the complainant and the target, he also informed the parliamentary groups of CDS-PP and Chega of the decision, “taking into account the respective connection with the facts under consideration”.
