The Public Ministry (MP) archived the case in which José Guilherme Aguiar, vice-president of the Chamber of Vila Nova de Gaia, of the executive who is now out of office, was being investigated for the death of a 5-year-old boy, following a run-over that occurred in 2022, advances this Sunday, October 26th, the Morning Mail.
The prosecutor considered, as the CM writes, that the then councilor of the Chamber of Gaia had no way of preventing the accident and that the child’s grandmother “violated the special duty of care incumbent upon her, as he was in her care”. The grandmother will have to hand over 800 euros to the Portuguese Association of Parents and Friends of Mentally Disabled Citizens. As he has no criminal record, he benefits from the provisional suspension of the process, says the CM.
The prosecutor states that the mayor was traveling at 11 km/h. The minor reportedly lost his balance after running out of a grocery store and fell onto the road.
As a local authority source revealed at the time, the councilor was “in a state of shock and had to be assisted” by the team from the National Institute of Medical Emergency (INEM).
The child’s mother disputes the decision and asked for the investigation to be opened, with the process being sent to the Porto Criminal Investigation Court, according to the CM.
